By accessing or using Quizingo ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

Quizingo is a quiz platform that allows users to:

• Create interactive quizzes with customizable grid layouts (3x3, 4x4, or 5x5)
• Set time limits for questions (10, 20, 30 seconds, or no timer)
• Share quizzes via game codes
• Play quizzes created by others

There is no minimum age requirement to use Quizingo. However, if you are under the age of 13 (or the applicable age of digital consent in your jurisdiction), you must have parental or guardian permission to use the Service.

Creating an Account

• Account creation requires Google OAuth authentication
• You are responsible for maintaining the confidentiality of your account
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use of your account

Account Security

• Do not share your account credentials
• We are not liable for losses due to unauthorized use of your account
• You may not use another user's account without permission

Quiz Content Ownership

You retain all ownership rights to the quiz content you create. By creating content on Quizingo, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely for the purpose of operating the Service.

Content Standards

When creating quizzes, you agree not to create content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains harmful, threatening, abusive, harassing, defamatory, or hateful material
• Contains sexually explicit or obscene content
• Promotes violence, discrimination, or illegal activities
• Contains viruses, malware, or other harmful code
• Impersonates any person or entity
• Contains spam or unauthorized advertising

Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) without permission
• Reverse engineer or attempt to extract source code
• Collect user information without consent
• Circumvent any security or access control mechanisms
• Create multiple accounts to abuse the Service

Our Rights

The Quizingo platform, including its design, features, text, graphics, logos, and software, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Rights

You retain full ownership of all quiz content you create. We do not claim ownership of your questions, answers, or quiz configurations.

Third-Party Content

You are responsible for ensuring you have the right to use any content you include in your quizzes. We are not responsible for any copyright or intellectual property violations in user-generated content.

• Quizzes are accessible via unique game codes
• Game codes can be shared with anyone
• You are responsible for who you share your game codes with
• We reserve the right to disable game codes that violate these Terms

Current Service

Quizingo is currently provided free of charge.

Future Freemium Model

We reserve the right to introduce paid features in the future. If we implement a freemium model:

• Existing free features will remain available or we will provide reasonable notice
• Pricing and terms for premium features will be clearly communicated
• Your continued use of paid features constitutes acceptance of payment terms

No Guarantee of Availability

We strive to maintain Service availability but do not guarantee uninterrupted or error-free operation. We may:

• Perform maintenance that temporarily affects availability
• Modify or discontinue features with or without notice
• Suspend or terminate the Service at any time

Your use of Quizingo is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Data Management

• You can edit or delete your quiz data at any time

• Currently, there is no automated account deletion feature

Quizingo uses third-party services including:

• Google OAuth for authentication
• Supabase for data storage
• PostHog for analytics

Your use of these services through Quizingo is subject to their respective terms and policies. We are not responsible for third-party service failures or policy changes.

No Liability for Content

We are not responsible for user-generated content. We do not endorse, verify, or guarantee the accuracy of any quiz content.

User Responsibility

You are solely responsible for:

• Your use of the Service
• Content you create or share
• Compliance with applicable laws
• Any consequences of sharing game codes

You agree to indemnify, defend, and hold harmless Quizingo and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Content you create or share on the platform

By You

By Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Prolonged inactivity
• Any reason at our sole discretion

Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data in accordance with our Privacy Policy
• Provisions that should survive (ownership, disclaimers, limitations) remain in effect

We reserve the right to modify these Terms at any time. Changes will be effective when posted with an updated "Last Updated" date. Material changes will be communicated through:

• Email notification (if contact information is available)

Your continued use of Quizingo after changes constitutes acceptance of the modified Terms.

We reserve the right to:

• Add, modify, or remove features
• Change the Service functionality
• Introduce new terms for new features
• Discontinue the Service entirely

We will provide reasonable notice for significant changes when feasible.

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Quizingo should first be attempted to be resolved informally by contacting us. If informal resolution fails, disputes will be resolved through binding arbitration or small claims court in your jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Quizingo regarding the Service and supersede any prior agreements.

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
